Ban if resignation with NOC for 5 months work Dubai

Dear Sir,

My brother worked for a sales shop from past 5 months. Now his employer has cancelled the visa on 28 jan 10 and is ready to provide him the NOC.
Now my question is that my brother has got a new job offer with a big co. So will my brother get a 6 months ban even after he gets a NOC (from old employer) and appointment letter from the new employer.

My understanding is that a 6 month UAE labour ban is automatic unless an exemption applies. In this case I don't see that an exemption will apply. An NOC is only useful if the employee has been with the company for more than 1 year on an unlimited contract, but check with the UAE Ministry of Labour to confirm that (and let us know if they say anything different ). They can also give you details of possible payment of a ban lifting fee.
