NOC issuance from company in UAE

I am electrical engineer 63+. I joined a new company 8 months back by producing a NOC from previous company who ahd issued me termination letter,after serving for 1 year and 4 months.

Now, new company has issued me termination letter(as I said, after serving 8 months), last date-31-01-10.

In the mean time I have secured another job,where the submission of NOC from present employer is a must.

Now I want to know whether present company can deny issuance of NOC?

Is not mandatory for the present co. to issue NOC against offer letter from new employer.

Please explain in detail.

2. The issue of a No Objection Certificate or letter (NOC) is not compulsory, it is up to the employer whether or not they choose to issue one.

NOC AND BAN

Further to my last message I would like to know-
1.I being engineer ban is applicable?
2.If noc is not given by employer how I can avoid ban? If payment is to be made to lift the ban where and when I should remit the money? After making payment how much time required to lift the ban and get visa from new employer?
3.Ban lift-payment can it be made in advance to avoid the delays?
4.When noc is issued and given to new employer,can I visit india for 2 weeks time,(of course without any ban)?

1. See the UAE labour ban information for more details. As far as I know, being an engineer is not relevant under current rules, but under old rules, engineers were exempt. Check with the UAE Ministry of Labour (and let us know if they say anything different :)).

2. There might be a ban lifting fee that you can pay, I have heard figures of AED 500 per month remaining on contract, or AED 5000, but have not seen official confirmation. Check with the MOL if that is possible, and how to pay it.

3. See #2.

4. I don't know about Indian immigration rules so I don't know how a ban here affects you in India, but I would guess there is no problem. You could exit the UAE when you leave current employer, go to India for two weeks, and return on new visa for new employer.
